- Joint filing – spouses can file together, which often reduces the tax payable.
If you were married for the entire tax year during which marital community property existed, you can take advantage of joint filing, which often reduces the amount of tax payable.
Joint filing is also possible when:
❤️ You entered into marriage during the tax year and remained married and in community property until the end of the year.
❤️ Your spouse died during the tax year or after its end, but before filing the return.
What are the benefits?
- Tax is calculated on half of the combined income, which often means a lower tax rate.
- If one of you did not earn income or stayed within the tax-free amount (30,000 PLN in 2024), joint filing can significantly reduce the tax due.
- Deductions and exemptions – e.g., the child tax credit, which may be more beneficial for married couples with children.

- Inheritance and gift tax – spouses are exempt from tax when transferring assets to each other.
- Spouses belong to the so-called tax group zero. In this situation, in each of the above gift scenarios, gift tax will not apply. It should be remembered that if the value of a gift from a spouse exceeds the tax-free amount in inheritance and gift tax within 5 years – 36,120 PLN – it must be reported to the appropriate tax office. The report must be submitted on form SD-Z2 within 6 months.
Well, love can be risky… and in taxes it doesn’t always pay off! Although marriage offers many fiscal benefits, it also has its downsides worth remembering:
- Liability for tax obligations – if your partner has arrears with the tax office, joint filing may mean that the tax authorities will also claim your share. Community property means sharing not only joys, but also potential debts.
